VACATION RENTAL AGREEMENT
This vacation rental contract is a legal agreement between Cabins & Condos of Branson LLC (also referred to as the Owner) and you (also referred to as the Renter or Guest), (whether one or more). This contract is entered into a mutual agreement as of the date when the Renter placed their reservation online and the reservation is accepted by the Owner. The Owner will notify the Renters by email when their reservation is accepted. The Owner reserves the right to refuse service to anyone for any reason. Owner leases to Renter the premises
, referred to as the “premises.” Renter agrees to rent the premises from Owner and Owner agrees to rent the premises to Renter for the nights reserved and paid for. The reservation is not transferable to any other party.
CLEANING & LINEN SERVICE POLICY: The home is provided with pillows, linens, blankets, comforters, towels, kitchen towels, hand towels & washcloths including extras located in closets/cabinets. Any towels/blankets/linens removed from the property will result in the cost of that item being charged. Also included is a supply of face and hand soaps, shampoos, dish soaps, and other sundries. The home is provided with a generous starter set of toilet paper & paper towels. Owners do not guarantee that these extra items will always be available, and guests will need to replenish them on their own as needed.
RENTAL AGREEMENT: We, the Renter (also referred to as “Guest”) agree to the following:
PAYMENT DUE - Full rental payment is due at time of booking according to the payment schedule disclosed under the payment policy as presented online in the reservation acceptance.
RESERVATION CANCELATION - 60 DAYS or MORE before check-in, Renter will receive a FULL REFUND of the amounts paid minus a credit card processing fee of 3.5%. EARLY DEPARTURE - There are no refunds for early departure. CANCELATION 30 - 59 DAYS before check-in, Renter will receive a 50% REFUND of the amounts paid minus a credit card processing fee of 3.5%. CANCELATION 29 DAYS or LESS before check-in, Renter will forfeit the total rental. The total rental includes all charges on the paid-in-full invoice. The renter may mitigate this loss by purchasing Travel Insurance or Cancel for Any Reason Insurance offered by a third-party provider.
WEATHER CONDITIONS - There are NO REFUNDS for changing weather conditions. (Optional travel insurance is available for Renter’s protection or Renter may obtain it through a third party. Renter ASSUMES THE RISK).
CONDITION OF PROPERTY – The Owner has, to the best of their ability, given an accurate description of the property and its condition. The Guest understands that it is considered reserved - sight unseen. Our cleaning staff will have cleaned it before your occupancy. All amenities such as electrical, internet services, cable TV, plumbing, and appliances are in good working order. The failures of operation of the above-stated amenities, such as TVs, cable or the Internet and WIFI service are not a basis for any refund. When you arrive, if you find that the home has not been cleaned or there is some unsatisfactory issue, please notify the Owner immediately. We will do our best to attend to the issue quickly, and if necessary, we will have tradesmen dispatched to inspect and/or repair an item as fast as feasible. The Guest agrees to hold the Owner harmless from any liability for the condition of the house.
CLEANING & REPAIRS - Our home has cleaning included in the cleaning fee paid at time of booking. Please note that the cleaning fee does does not include dishes & cooking utensils, guest is responsible for cleaning of dishes/utensils/cookware. If additional cleaning is required after you leave, it will be charged to the platform in which you booked the premesis. Guest agrees to keep the house, furniture and furnishings in good order and in same locations as originally found. Guest is responsible for cost of replacement of any damage to furniture or premises and replacement of any missing items.
ACCIDENTAL DAMAGE INSURANCE – Renter is required to purchase damage protection at time of booking. Renter will be completely responsible for any and all damage to the home or property caused by Renter, whether accidental or due to Renter’s negligence.
ASSUMPTION OF RISK - No lifeguard will be on duty at the outdoor and indoor pool areas. Accordingly, persons using the pool do so at their own risk and the Owner assumes no responsibility for accident or injury. No one should swim alone. Guest will hold the Owner harmless from any and all bodily injury and/or property damage incurred on the property arising out of Guests' negligent acts or omissions. These risks are not limited to, but include access to the pools, outdoor play areas, adjacent streets, the stairs and cleaning supplies in the home. Due to the nature of a home with stairs and an external balcony, please use caution and common sense in and around the property. Please use our facilities at your own risk.
MISSING ITEMS - Guest will be charged for any missing items reasonably attributable to Guest and not returned after notification. The cleaning service performs an inventory/survey of the property after Guest departs and notifies the Owner of any missing items. Owner will notify guests in the event that items were inadvertently taken and provide guests the opportunity to return the missing items.
USE OF SECURITY CAMERAS - Renter understands and accepts that the property is protected with outside security cameras. These cameras are used to protect the property from potential break-ins and theft. There are NO cameras inside the home.
PERSONAL PROPERTY - Guest understands that any personal property of and used by Guest is not insured by Owner and Owner shall not be responsible for any lost, stolen or missing property of the Guest or property of Guest left after checking out. Owner shall not be responsible for Guest leaving streaming services/accounts signed in on smart TVs/devices or any cost incurred from leaving such accounts signed in.
NO PARTIES - This is a private residence and our vacation rental home. Our neighbors live here also. We ask that you please be respectful of our neighbors and the facilities. No parties, loud music or noise will be tolerated. The Renter must be 25 years of age to book this Vacation Rental. Any special occasions such as family reunions or increase of occupants (guests not registered on registration form) must be disclosed at the time the reservation is made and is subject to Owner's advanced approval.
NON-SMOKING HOME - This is a NO SMOKING vacation rental and our home. Please be respectful of this fact. Evidence of smoking, such as the smell of cigarette, e-cigarette or cigar smoke inside the home by the cleaning crew is sufficient basis to charge the renter for smoke cleanup and removal from carpeting, AC ducts & filters and furniture. This type of cleaning is very expensive, and Renter will be Liable for the Deep Cleaning Costs incurred. There is no smoking within 100 yards of any deck, patio, or condo entry.
NO PETS ALLOWED - If you bring a pet(s) into this property, this rental agreement will be forfeited, terminated and deposits will be retained and the Deep Cleaning Pet fee of $500 will apply.
Additionally, in agreement with Missouri Statute 209.204. Impersonating a person with a disability for the purpose of receiving certain accommodations, penalty, civil liability — misrepresentation of dog as service dog, penalty, civil liability — misrepresentation of animal as assistance animal, penalty, civil liability — placard, brochure. — 1. Any person who knowingly impersonates a person with a disability for the purpose of receiving the accommodations regarding service dogs under the Americans with Disabilities Act, 42 U.S.C. Section 12101, et seq., is guilty of a class C misdemeanor and shall also be civilly liable for the amount of any actual damages resulting from such impersonation. Any second or subsequent violation of this section is a class B misdemeanor. For purposes of this section, "impersonates a person with a disability" means a representation by word or action as a person with a disability.
2. No person shall knowingly misrepresent a dog as a service dog for the purpose of receiving the accommodations regarding service dogs under the Americans with Disabilities Act, 42 U.S.C. Section 12101, et seq. For purposes of this section, "misrepresent a dog as a service dog" means a representation by word or action that a dog has been trained as a service dog, as defined in section 209.200. Misrepresentation of a service dog *includes, but is not* limited to:
(1) Knowingly creating documents that falsely represent that a dog is a service dog;
(2) Knowingly providing to another person documents falsely stating that a dog is a service dog;
(3) Knowingly fitting a dog, if the dog is not a service dog, with a harness, collar, vest, or sign of the type commonly used by a person with a disability to indicate a dog is a service dog; or
(4) Knowingly representing that a dog is a service dog if the dog has not completed training to perform disability-related tasks or do disability-related work for a person with a disability.
A person who violates this subsection is guilty of a class C misdemeanor and shall also be civilly liable for any actual damages resulting from such misrepresentation. Any second or subsequent violation of this subsection is a class B misdemeanor.
MAXIMUM OCCUPANCY - is 6 total occupants (maximum of 6 adults).
PARKING – Limited Parking is available immediately outside the condo building. Parking is first come, first serve. Please be respectful of the other residents living in the adjoining condos.
CHECK-IN & CHECK-OUT - Check-in is at 4:00 PM and checkout is 10:00 AM. Unapproved late check-outs are subject to extra rental charges at the rate of $100/hour. PLEASE check out promptly, the cleaning crews have a very short time window to prepare the unit for new guests.
CHECK-OUT PROCEDURES - Renters are responsible to complete the check-out procedures as posted on the back of entry door and in the Welcome Guide. You are responsible that all trash is placed in plastic trash bags (provided) and transferred to trash dumpsters outside by the basketball court. Soiled dishes, pots, pans and cooking utensils should be placed in the dishwasher with a soap pod (provided) and turned on for washing before leaving.
DISCLAIMER: Renter understands that the Owner is not responsible for any personal injury or loss or damage to Renters’ property caused directly or indirectly from foul, inclement weather conditions, Acts of God or nature, accidents related to fire, heaters, stoves or Renters’ failure to take adequate precautions around wet areas, or any unforeseeable circumstances. This agreement and disclaimer apply to Renter and any/all guests in the Renters’ party. By following through with renting the property identified in this document, the Renter agrees to having read, understood, agrees to, and will abide by this rental agreement and all conditions stated herein.
